Terms of Service

These Terms govern your use of LittleNest, including accounts, private family spaces, shared family content, and account and family deletion.

Important dispute notice: Section 18 provides for binding individual arbitration administered by CIETAC after a 30-day informal-resolution period, subject to stated exceptions and any consumer rights that cannot lawfully be waived. Please read that section carefully.

1. Agreement and Operator

LittleNest is operated by Cai Lujia (蔡露佳), an individual developer using the developer name “Cailujia Studio” and based in Zhengzhou, Henan Province, People's Republic of China. In these Terms, “LittleNest,” “we,” “us,” and “our” mean Cai Lujia and the LittleNest service.

By creating an account, selecting a control that confirms your agreement, or otherwise using LittleNest, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use LittleNest.

2. Eligibility and Age Requirement

You must be at least 13 years old to hold and use a LittleNest account. You must also be legally capable of agreeing to these Terms. If the law where you live requires a higher minimum age or parental involvement for an online service, you may use LittleNest only if that requirement is satisfied.

LittleNest asks for the account holder's date of birth before the account can create or join a Nest. If the submitted date indicates that the account holder is under 13 and the user confirms it is correct, LittleNest will prevent use of the family service and delete the account.

An eligible account holder may create a non-account profile for another family member, including a child or baby. A non-account profile does not create sign-in access. If you add information or content about another person, you represent that you have the authority, permission, and lawful basis needed to do so.

3. The Service

LittleNest is a private family-memory service. It allows account holders to create or join private family spaces called “Nests,” maintain family member profiles, save and organize Moments, upload photos and videos, add captions, dates, locations and people tags, and view timelines, albums, calendars, recaps, reminders, memory cards, and widgets.

LittleNest is not a public social network, emergency service, child-location or safety-monitoring service, medical service, professional recordkeeping service, or guaranteed permanent archive.

4. Accounts and Sign-In

You must provide accurate information and keep control of the email, Apple account, Google account, device, or other sign-in method connected to your LittleNest account. You are responsible for activity conducted through your account unless applicable law provides otherwise.

You may not create an account for someone under 13, impersonate another person, sell or transfer an account, share an account to bypass Nest access controls, or use another person's authentication information. Notify [email protected] promptly if you believe an account or Nest has been accessed without authorization.

5. Nests, Members, and Family Authority

A Nest is private from the general public but shared among its active members. Members can generally see the Nest profile, member profiles, Moments, media, dates, locations, people tags, timelines, albums, and memory features associated with that Nest. LittleNest does not currently provide per-Moment visibility controls.

You are responsible for inviting only appropriate and trusted people, reviewing join requests, and understanding the effect of granting membership. Members may be able to view, copy, capture, download, or retain content on their devices. We cannot control a member's use of content after that member has lawfully accessed it.

The Nest creator controls certain administrative actions, including deleting the Nest. Users must not misrepresent a family relationship, guardianship, consent, or authority to create profiles, upload content, invite members, or manage a Nest.

6. Your Content

“Your Content” means information and material that you submit, create, or choose to save through LittleNest, including profile information, family member profiles, photos, videos, Live Photos, captions, notes, dates, saved locations, people tags, and feedback.

You retain ownership of Your Content. You grant LittleNest a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, format, create technical copies and thumbnails, transmit, and display Your Content only as reasonably necessary to provide, maintain, secure, troubleshoot, and improve the requested LittleNest features. This license ends when the relevant content is deleted from active systems, except for limited backup, legal, security, and shared-content retention described in these Terms and the Privacy Policy.

You represent and warrant that you have all rights and permissions necessary to provide Your Content and allow it to be used and shared within the relevant Nest. You remain responsible for Your Content and for deciding whether particular family or child information is appropriate to share with Nest members.

7. Acceptable Use

You may not use LittleNest to create, upload, store, share, request, promote, or facilitate:

Nest members may report a Moment or an account-backed family member through the reporting controls in the app. Reports are confidential and may be used to investigate possible violations of these Terms.

We may remove or restrict prohibited content, preserve evidence, suspend or terminate access, and report apparent child exploitation, credible threats, or other unlawful activity to service providers or authorities when required or permitted by law. LittleNest does not promise to monitor every private Nest or review content before it is uploaded.

8. Privacy, Birthdays, Locations, and Device Features

Our Privacy Policy explains how LittleNest processes account information and family content. By using a permission-dependent feature, you instruct LittleNest to access the relevant information for that feature.

The account holder's birthday is used to apply the 13+ account requirement and may support birthday and age-related memory features. Birthday information may be visible to members of Nests you join. Birthdays for non-account member profiles do not determine whether an account is eligible to use LittleNest.

Saved locations and media location metadata can reveal sensitive information about people and families. Add a location only when you are comfortable sharing it with all active members of the relevant Nest. LittleNest does not continuously track users and does not request background location access.

9. Content, Nest, and Account Deletion

Deleting a Moment is designed to remove the active Moment record and its related media, saved location, people tags, and technical copies. Deleting a Nest is designed to remove that family space and its memberships, non-account profiles, invitations, join requests, Moments, media, locations, people tags, and related family records.

If you created a Nest, you must delete that Nest before deleting your account. Nest deletion affects every member and is intended to be permanent.

Before confirming in-app account deletion, you must choose whether to permanently delete the Moments you shared across all Nests or leave copies in the relevant family timelines without a link to your deleted account. If you choose deletion, those Moments and their related media and tags are intended to be permanently removed. If you leave copies, active Nest members may continue to access them and they may display an unavailable or removed creator.

Account deletion is designed to remove the authentication account, account profile, memberships, relevant join requests, identifiable profile media, and local session and cache information. Reports, feedback, support records, and a minimal deletion-completion record may remain when no longer linked to an active account or when needed for safety, support, security, legal, or recordkeeping purposes. Limited records may also remain temporarily in rolling backups or where retention is legally permitted or required.

Deletion cannot be undone, and LittleNest does not provide a recycle bin or guarantee recovery. See Account Deletion for instructions.

10. Third-Party Services

LittleNest relies on providers for authentication, cloud database and file storage, transactional email, maps and location services, website hosting, app development and builds, app signing, and app-store distribution. Those providers may process information according to their own terms and policies. We are not responsible for third-party services that we do not control.

11. Free Service and Future Features

The first release of LittleNest is free and does not include a paid subscription or paid feature tier. We may add, change, or remove features in the future. If we introduce a charge, subscription, storage plan, or in-app purchase, we will disclose the price and applicable purchase, renewal, cancellation, and refund terms before you are charged.

12. Availability, Changes, and Backups

We may maintain, update, change, limit, suspend, or discontinue all or part of LittleNest. We try to provide a reliable service, but we do not guarantee uninterrupted availability, error-free operation, compatibility with every device, or that every feature will remain available.

LittleNest is not a permanent archival service. Database backups are maintained for limited disaster-recovery purposes, and database backups do not include the actual photo and video objects stored through the file-storage service. We do not provide a media recycle bin, version history, or guaranteed restoration of accidentally deleted content. Keep independent copies of important photos, videos, and memories.

13. LittleNest Intellectual Property

LittleNest's software, design, interfaces, branding, logos, documentation, and non-user content are owned by the LittleNest operator or licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the app for its intended family-memory purposes.

14. Feedback

If you submit product ideas or suggestions, you permit us to use them without restriction or payment to improve LittleNest. This does not transfer ownership of photos, videos, family profiles, or other private family content included with a support request.

15. Suspension and Termination

You may stop using LittleNest at any time and may delete your account subject to the Nest-creator rule. We may restrict, suspend, or terminate access when reasonably necessary to address a Terms violation, unlawful or harmful activity, child exploitation, security or privacy risk, legal requirement, prolonged operational impossibility, or discontinuation of the service.

Where appropriate and legally permitted, we will provide notice and an opportunity to address the issue. Immediate action may be necessary for security, child safety, legal compliance, or prevention of harm.

16. Disclaimers

To the fullest extent permitted by law, LittleNest is provided “as is” and “as available.” We disclaim express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and preservation of data.

Nothing in these Terms excludes a warranty, guarantee, remedy, or other consumer right that cannot lawfully be excluded or limited.

17. Limitation of Liability

To the fullest extent permitted by law, the LittleNest operator and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, opportunities, or data, arising out of or relating to LittleNest.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to LittleNest or these Terms will not exceed the greater of US$100 or the amount you paid directly to LittleNest during the 12 months before the event giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited or excluded. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

18. Governing Law and Dispute Resolution

Informal resolution first

Before starting arbitration, the claimant must send a written notice describing the dispute, the relevant account email, the facts, and the requested relief to [email protected]. The parties will attempt in good faith to resolve the dispute for 30 days after the notice is received. This requirement does not prevent either party from seeking urgent relief when delay would cause irreparable harm or from meeting a legal filing deadline.

Governing law

These Terms and any dispute arising from them or LittleNest are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles. This choice does not deprive you of consumer protections or other rights that the law where you live does not permit you to waive by contract.

Binding CIETAC arbitration

If a dispute is not resolved through the 30-day informal process, it will be submitted to the China International Economic and Trade Arbitration Commission (“CIETAC”) for binding arbitration under the CIETAC Arbitration Rules in effect when the arbitration is commenced. The seat of arbitration will be Zhengzhou, Henan Province, People's Republic of China. The arbitration language will be English. The dispute will be decided by one arbitrator unless the applicable rules or CIETAC require otherwise. Electronic filing and a remote hearing may be used when permitted by the applicable rules and the tribunal.

The tribunal may award any remedy available under applicable law on an individual basis. Fees and costs will be allocated under the CIETAC Rules, applicable law, and the tribunal's decision. LittleNest will not seek to shift arbitration costs to a consumer where doing so is prohibited by applicable law.

Individual proceedings and exceptions

To the fullest extent permitted by law, disputes must be brought in an individual capacity and not as a plaintiff or class member in a class, collective, consolidated, representative, or private-attorney-general proceeding. The arbitrator may grant relief only to the individual party seeking relief and only as necessary to resolve that party's claim.

Either party may bring an eligible individual claim in a small-claims court that has lawful jurisdiction. Either party may also seek temporary or injunctive relief from a court with jurisdiction to protect intellectual property, account security, confidential information, or the safety of a person while arbitration is pending. Nothing in this section prevents a user from filing a complaint with a government or regulatory authority.

Effect and severability

The arbitration agreement in this section is intended to be independent of the remaining Terms. If a particular restriction in this section is unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will continue to apply unless applicable law requires otherwise.

19. Apple and Google App Store Terms

If you downloaded LittleNest through Apple or Google, the applicable store terms also apply. Apple and Google are not parties to these Terms, are not responsible for operating or supporting LittleNest, and have no obligation to provide maintenance or support for the app except as required by their own terms or applicable law. Nothing in these Terms limits rights you have against an app store under its terms or applicable law.

20. Changes to These Terms

We may update these Terms to reflect changes in LittleNest, law, providers, or risk. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice and obtain agreement when required by law. Changes do not retroactively alter a dispute that arose before the updated Terms became effective unless both parties agree.

21. General Terms

If a provision of these Terms is invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective, subject to the specific rule in Section 18. Our failure to enforce a provision is not a waiver. You may not transfer these Terms or your account without our consent. We may transfer these Terms as part of a reorganization, financing, merger, acquisition, or transfer of the service, subject to applicable law.

These Terms, the Privacy Policy, and any additional terms presented for a specific feature form the entire agreement between you and LittleNest concerning the service. Headings are for convenience only.
